Last month, a Federal Court upheld a previous ruling that information contained in export license applications is protected from public disclosure by the EAA's §12(c) provision. As such, companies can continue to include proprietary data in their applications to BIS without fear of sensitive information being subject to a FOIA request. While the decision resurrects the EAA's nondisclosure provision, it may also delay passage of new legislation.
