DRAFT SAFE-HARBOR RULES RAISE CONCERNS AMONG EXPORT LAWYERS

Draft version of BIS "safe harbor" rules, which would give immunity from legal action to firms that properly check foreign customers against 'red flags' and resolve any that are raised, has drawn concerns from members of the export legal bar who have seen it. They fear voluntary procedure could become de facto licensing requirement and how BIS will use information submitted.
