Encryption Export Controls May Fail Constitutional Test

Given the long-running battle between software publishers and the U.S. Government over encryption export controls, the interim rules and the contrasting viewpoints expressed in the two court decisions pose serious obstacles to U.S. software exporters who risk a permanent loss of market share to their less-encumbered foreign competition.
