BIS finally published the regulation amending encryption rules, which represents a significant change of U.S. policy towards exports of encryption items. The new rule allows consumers around the world to have access to strong encryption independent of key length. The new measure also clarifies license exception ENC, liberalizes “mass market” designation, and streamlines “retail” qualification requirements. Despite these and other perks, the latest complex rule will still have export managers scratching their heads.
